All photographs created by Ariel Jade Imagery remain the exclusive property of the photographer, regardless of whether digital files or prints are delivered to the client.
Copyright is not transferred to the client unless explicitly agreed to in writing through a separate commercial licensing agreement.
2. Client Usage Rights (Personal Use License)
Clients are granted a non-transferable, non-exclusive license to use their images for personal purposes only, including:
• Personal printing and display
• Sharing on personal social media accounts
• Creating personal keepsakes (albums, frames, gifts)
Personal use does not include commercial, promotional, or monetary use.
3. Social Media Sharing
Clients may share images on personal social media platforms under the following conditions:

• The photographer’s watermark may not be removed

Images may not be altered in a way that misrepresents the photographer’s work or artistic style. This includes applying presets, filters, heavy retouching, or AI manipulation.
Ariel Jade Imagery maintains full artistic discretion in editing, curation, and delivery.
8. Copyright Infringement
Unauthorized use of images constitutes copyright infringement and may result in:
• Immediate revocation of usage rights

Terms & Conditions

These Terms & Conditions (“Agreement”) govern all photography services provided by Ariel Jade Imagery (“we,” “us,” or “our”). By booking a session or using our website, you (“the Client”) agree to the terms outlined below.
1. Booking & Retainer
• A signed contract and non-refundable retainer are required to secure your session date.
• Retainers are applied toward the total session cost and are non-refundable under all circumstances.
• Session dates are not confirmed until both the contract and retainer are received.
2. Payment Terms
• The remaining balance is due prior to or on the session date, unless otherwise agreed in writing.
• Payment plans may be offered at our discretion.
• Failure to complete payment may result in delayed or withheld image delivery.
3. Cancellations, Rescheduling & Force Majeure
Client-Initiated Cancellations
• Retainers are non-refundable.
• If a session is cancelled, any additional payments made may be forfeited depending on timing and circumstances.
Rescheduling
• One reschedule may be granted with reasonable notice, subject to availability.
• Additional reschedule requests may incur a fee.
Force Majeure
Ariel Jade Imagery shall not be held liable for failure to perform due to circumstances beyond reasonable control, including but not limited to:
• Illness, injury, or hospitalization (including that of the photographer’s child)
• Acts of God, natural disasters, or extreme weather
• Government restrictions or public health emergencies
In such cases, we will make reasonable efforts to reschedule or provide an alternative solution.
4. Birth Photography & On-Call Services
• Birth photography availability is not guaranteed due to the unpredictable nature of labor and delivery.
• Clients acknowledge that missed moments may occur due to medical circumstances, timing, or access limitations.
• On-call periods and coverage details will be outlined in the individual service agreement.
5. Artistic Style & Creative Discretion
• The Client acknowledges familiarity with Ariel Jade Imagery’s portfolio and style.
• Editing, curation, and image delivery are performed at the photographer’s artistic discretion.
• Specific poses, moments, or images are not guaranteed.
6. Image Delivery
• Image delivery timelines vary by service and will be outlined in the service agreement.
• Rush delivery is not guaranteed and may incur an additional fee.
• Unedited or RAW images are not provided under any circumstances.
7. Client Responsibilities
• Clients are responsible for securing permissions and access to locations.
• Clients must inform the photographer of any restrictions, sensitivities, or privacy requests prior to the session.
• Failure to cooperate may impact the quality or completeness of the final gallery.
8. Model Release & Usage
• Unless otherwise stated in writing, the Client grants Ariel Jade Imagery permission to use images for portfolio, website, social media, and promotional purposes.
• Requests for image privacy must be made in writing prior to the session.
• Additional fees may apply for full model release opt-outs.
9. Copyright & Image Use
• Ariel Jade Imagery retains full copyright ownership of all images.
• Clients receive a personal use license as outlined in the Copyright & Image Usage Policy.
• Unauthorized use may result in revocation of usage rights and legal action.
10. Limitation of Liability
• Ariel Jade Imagery’s liability is limited to the return of payments received.
• We are not responsible for missed images due to factors outside our control.
• Clients agree to release Ariel Jade Imagery from liability for personal injury or property damage incurred during sessions, except where prohibited by law.
11. Archiving & File Retention
• Image files are archived for a limited time after delivery.
• Clients are responsible for downloading and backing up their images promptly.
• We cannot guarantee long-term file storage.
12. Website Use
• Content on this website may not be copied, reproduced, or distributed without written permission.
• Use of this website constitutes acceptance of these Terms & Conditions.
13. Governing Law
This Agreement is governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein.
